Terms of Service

Effective date: November 5, 2026

Welcome to Mumbies. These Terms of Service ("Terms") are an agreement between you and Mumbies Inc., a Delaware corporation registered to do business in Wisconsin ("Mumbies," "we," "us"), located at 9924 Monarch Drive, Unit 5202, Franklin, WI 53132. They apply when you visit mumbies.com, partners.mumbies.com, our wholesale portal, or any other site or service that links to these Terms (together, the "Services").

By using the Services or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

Please read Section 15 (Disputes). It requires most disputes to be resolved by binding individual arbitration instead of in court, and it waives class actions and jury trials. You can opt out of arbitration within 30 days, as Section 15 explains.

1. Who can use Mumbies

You must be at least 18, or the age of majority where you live, to create an account or buy from us. The Services are not directed to children under 13, and we do not knowingly collect personal information from them.

2. Your account

Customer accounts on mumbies.com are provided through Shopify's customer account system. Partner and wholesale accounts have their own sign-in.
Keep your sign-in details secure and your information accurate. You are responsible for activity on your account.
Tell us at support@mumbies.com if you think someone has accessed your account without permission.
We may suspend or close accounts that break these Terms or that we reasonably believe are being used for fraud or abuse.

3. Orders and payment

Checkout and payment are processed by Shopify. We don't store your full card number.
An order is an offer to buy. We accept it when we ship it or confirm it by email. We may limit or cancel orders, including suspected fraud, resale, or orders affected by a pricing or stock error.
You authorize us and our payment processor to charge your payment method for the order total, including taxes and shipping.

4. Prices and errors

We try hard to show accurate prices, product details and availability, but mistakes happen. If an item is listed at the wrong price or with wrong information, we may cancel the order or contact you before shipping, even after you receive a confirmation. If you've already been charged for a cancelled order, we'll refund you. Prices and promotions can change at any time but won't change an order we've already accepted.

5. Shipping, returns and refunds

Shipping and delivery are covered in our Shipping Policy. Returns and refunds are covered in our Refund Policy. If either policy conflicts with these Terms, that policy controls for shipping, returns and refunds.

6. Subscriptions and Mumbies Box

Subscribe & save and Mumbies Box renew automatically until you cancel. Our Subscription Terms explain billing, timing, and how to skip, pause or cancel online. They are part of these Terms.

7. Mumbies Cash, discount codes and promotions

Mumbies Cash is promotional store credit we may give you (for example, for a review or a referral). It has no cash value, can't be sold or transferred except where we say so, and can't be redeemed for cash except where the law requires it. Mumbies Cash may expire; when it does, the expiry date is shown in your account. If your account is closed, any unused Mumbies Cash ends with it, unless the law requires otherwise.
Discount codes and promotions have the terms shown with them, are one per order unless stated, and may be withdrawn for misuse.
Giveaways are governed by their own Official Rules.

8. Product use

Our chews and treats are for dogs. Always supervise your dog while chewing, choose the right size, and remove small or broken pieces. Check with your veterinarian if your dog has health conditions or dietary needs. Product information on our site is not veterinary advice.

You may be able to post reviews, ratings, photos, videos, dog profiles, questions and other content ("Your Content"). Our Review Guidelines apply.

You keep ownership of Your Content.
License to us. You give Mumbies a non-exclusive, royalty-free, worldwide, transferable and sublicensable license to host, store, reproduce, display, publish and distribute Your Content, and to make minor edits for formatting or length (never changing its meaning), in connection with operating and promoting the Services, including showing your review and media on our product pages and in our emails. This license lasts as long as Your Content is on the Services, plus a reasonable period to remove it from backups and from materials already produced.
Your promises. You confirm that Your Content is honest and based on your real experience, that you own it or have permission to share it (including from anyone shown in a photo or video), and that it doesn't break the law or anyone's rights.
We may moderate, decline or remove Your Content for any reason consistent with our Review Guidelines, but we don't remove reviews just because they're negative.
If you tag @getmumbies on social media, we may see that post through the platform's tools. We'll ask you before reposting it.

10. Things you agree not to do

Break the law or anyone else's rights.
Post fake, paid-for-without-disclosure, or misleading reviews, or reviews of products you haven't used.
Abuse promotions, referral links, giveaways or Mumbies Cash (for example, multiple accounts or self-referrals).
Scrape, copy or harvest the Services or other users' data, or use bots without our permission.
Interfere with the Services' security or operation, or try to access accounts or systems that aren't yours.
Resell products bought at retail without a wholesale agreement with us.
Upload malware, spam, or content that is harassing, hateful, sexually explicit or infringing.

11. Our intellectual property

The Services, including the Mumbies name, logos, product designs, text, photos and software, are owned by Mumbies or our licensors and protected by law. We give you a limited, personal, revocable permission to use the Services as intended. Nothing in these Terms transfers our IP to you. If you send us feedback or ideas, we may use them without obligation to you.

If you believe content on the Services infringes your copyright, see our Copyright Policy.

13. Disclaimers

The Services and products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted or error-free. Any promise we make about a product, such as a satisfaction guarantee, is stated in our Refund Policy or on the product page, and is the only promise we make about it. Some places don't allow these disclaimers, so they may not apply to you.

14. Limitation of liability and indemnity

Limitation. To the fullest extent the law allows, Mumbies will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from the Services or products. Our total liability for any claim is limited to the greater of (a) $100 or (b) the amount you paid us for the product or service giving rise to the claim in the 12 months before the claim. Nothing in these Terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence where applicable law prohibits it.

Indemnity. You agree to defend and indemnify Mumbies against third-party claims arising from Your Content or your breach of these Terms, to the extent permitted by law.

15. Disputes

Please contact us first at support@mumbies.com — most issues are resolved quickly that way. Before starting arbitration or a court case, you and we each agree to send the other a written description of the dispute and to try in good faith to resolve it for 30 days. Our notices to you go to the email address we have for you.

Governing law: The laws of the State of Wisconsin govern these Terms, without regard to its conflict-of-law rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below.
Binding individual arbitration: Except as stated below, you and Mumbies agree that any dispute, claim or controversy arising out of or relating to these Terms, the Services or any product you buy from us will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at adr.org. A single arbitrator decides the dispute and may award the same individual relief a court could. The arbitration may take place by video, by phone, on written submissions, or in person in the county where you live, as the AAA rules allow. Fees are paid as the AAA Consumer Arbitration Rules provide. The arbitrator decides all questions about the arbitration, except that a court decides questions about the class-action waiver and the opt-out below.
Exceptions: Either of us may bring an individual claim in small claims court instead, as long as it stays there. Either of us may also go to court to stop infringement or misuse of intellectual property.
Class-action and jury waiver: You and Mumbies each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of more than one person. You and we waive any right to a jury trial. If this class-action waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
30-day opt-out: You can opt out of this arbitration agreement by emailing support@mumbies.com within 30 days after you first accept these Terms, with the subject "Arbitration opt-out" and your name and the email address on your account or order. Opting out doesn't affect any other part of these Terms.
Courts: Any dispute not resolved by arbitration, including a small claims case and any claim that is opted out, will be decided exclusively by the state and federal courts located in Wisconsin, and you and Mumbies consent to their personal jurisdiction.

16. Changes to these Terms

We may update these Terms. We'll post the new version with its effective date. For material changes, we'll give you notice by email (if we have your address) and/or a notice on the site at least 30 days before the change takes effect, unless the change is required sooner by law. Continuing to use the Services after the effective date means you accept the updated Terms. Changes don't apply to disputes that arose before the effective date.

17. Other terms

These Terms, together with the policies they link to, are the entire agreement between you and us about the Services. If any part is unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
